Article 1 – Purpose
These conditions govern the sales by the company ESC Laboratoire whose head office is located 45 route de Chaluzy – 58000 SAINT ÉLOI, of care products and food supplements for horses.
Article 2 – Prices
The prices of our products are shown in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping costs.
In case of order to a country other than metropolitan France you are the importer of the product(s) concerned. Customs duties or other taxes
import duties or state taxes may be payable.
These fees and sums are not the responsibility of ESC Laboratoire. They will be your responsibility and responsibility, both in terms of declarations and payments to the competent authorities and bodies of your country. We advise you to consult your local authorities about these aspects.
All orders regardless of origin are payable in euros.
The company ESC Laboratoire reserves the right to change its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of validation of the order and subject to availability.
The products remain the property of the company ESC Laboratoire until full payment of the price.
Caution: as soon as you take physical possession of the ordered products, the risk of loss or damage to the products is transferred to you.

The contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.
The company ESC Laboratoire reserves the right not to register a payment, and not to confirm an order for any reason, particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Article 4 – Validation of your order
Any order placed from the website www.esclaboratoire.com assumes adherence to these Terms and Conditions. Any order confirmation will result in your full adherence to these Terms and Conditions without exception or reservation.
All the data provided and the recorded confirmation will be evidence of the transaction.
You say you have perfect knowledge of it.
The order confirmation will be valid for signature and acceptance of the operations performed.
A summary of the information about your order will be provided to you on the e-mail address communicated during the order and on your personal space created on the website www.esclaboratoire.com

Article 5 – Payment
Validating your order requires you to pay the price indicated.
Payment of your purchases can be made :
– By credit card thanks to the secure Paybox system provided by our financial partner Crédit Agricole. A payment in 3 times free of charge will then be offered,
– By bank transfer with immediate payment,
– By bank check sent to the address of the company by recalling the order number
– By deal to J+30 with RIB (except online banks)
Article 6 – Withdrawal
In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty.
Returns are to be made in their original and complete condition (package, accessories, package leaflet). In this context, your responsibility is engaged. Any damage suffered by the product on that occasion may be such as to defeat the right of withdrawal.
Return costs are borne by the buyer.
In the event of the exercise of the right of withdrawal, ESC Laboratoire will refund the sums paid, within 14 days of the notification of your request and via the same means of payment as used at the time of the order.
EXCEPTIONS TO THE RIGHT OF RETRACTATION
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
The supply of goods made according to consumer specifications or clearly personalized.
The provision of goods that are likely to deteriorate or perish rapidly.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
The supply of goods which, after having been delivered and by their nature, are inextricably mixed with other articles;
Article 7 - Availability
Our products are available as long as they are visible on the website www.esclaboratoire.com and within the limits of available stocks. In case of unavailability of product after placing your order, we will inform you by email. Your order will be automatically cancelled and no bank debit will be made.
Article 8 – Delivery
The products are delivered to the delivery address indicated during the order process, within the time specified on the order validation page.
In case of delay in shipping, an email will be sent to inform you of any consequences on the delivery time indicated to you.
In accordance with the legal provisions, in case of delay of delivery, you have the possibility of cancelling the order under the conditions and procedures laid down in article L 138-2 of the Consumer Code. If in the meantime you receive the product we will make its refund and shipping costs under the conditions of article L 138-3 of the Consumer Code.
In the event of deliveries by a carrier, the company ESC Laboratoire cannot be held responsible for delay of delivery due exclusively to unavailability on your part after several appointment proposals.
Delivery costs are calculated according to the weight and destination of the order. They are communicated to you at the time of the order process. In case of an order by email, telephone or fax, you can consult the price for your order by sending us an email to contact@esclaboratoire.com
More than 750 euros including VAT, delivery costs are free.
Article 9 – Guarantee
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects provided for in articles 1641 et seq. of the Civil Code. In the event of non-compliance with a product sold, it may be returned, exchanged or refunded.
All claims, exchange or refund requests must be made by email at the following address: contact@esclaboratoire.com within 30 days of the date of delivery.
The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, package notice...). The shipping costs will be reimbursed on the basis of the invoiced rate and the return costs will be refunded upon presentation of the proofs.
The provisions of this Article do not prevent you from enjoying the right of withdrawal provided for in Article 6.
Article 10 – Liability
The proposed products comply with the French legislation in force. The company ESC Laboratoire cannot be held liable for failure to comply with the legislation of the country in which the product is delivered. It is up to you to check with local authorities the possibilities of importing or using the products or services you plan to order.
In addition, ESC Laboratoire cannot be held liable for damages resulting from improper use of the purchased product.
Finally, the company ESC Laboratoire cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including a breakdown of service, an outside intrusion or the presence of computer viruses.
Article 11 – Law applicable in disputes
The language of this contract is the French language. These conditions of sale are subject to French law. In the event of a dispute, the French courts will be the only competent courts.
Article 12 – Intellectual property
All elements of the website www.esclaboratoire.com are and remain the intellectual and exclusive property of the company ESC Laboratoire. No person shall be permitted to reproduce, exploit, rebroadcast, or use, in any capacity whatsoever, even in part, elements of the site, whether they are software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of ESC Laboratoire.
Article 13 – Personal data
ESC Laboratoire reserves the right to collect personal information and personal data about you. They are necessary to manage your order, as well as to improve the services and information we send you.

ESC Laboratoire's computerized records will be considered by all parties concerned as evidence of communications, orders, payments and transactions between the parties.
